COPPA NOTICE TO PARENTS AND GUARDIANS
NOTICE TO PARENTS AND GUARDIANS OF INFORMATIONAL PRACTICES WITH REGARD TO CHILDREN
http://www.techdeck.com (the "Site") is a web site owned and operated by SPIN MASTER,
LTD for kids and adults to provide a forum for discussion, evaluation,
and sale of miniature replica sports equipment and accessories such as
skateboards and snowboards. In order for your child to enjoy all of the
information and services that we provide, your child may register for
our service. The registration process begins when your child
electronically indicates to us that he or she is under 13. If your
child indicates that he or she is under 13, we will ask your child to
provide only his or her first name and your email address.
Subsequently, we will send a message to your email address, asking you
to set up your child as a registered user of the Site ("Member"), so
that your child can have access to content and/or services on the Site
("Membership"). That email message will include a link to this Notice
to Parents and Guardians of Informational Practices with Regard to
Children ("Notice"). This procedure is designed to protect the privacy
of your child and to comply with the Children's Online Privacy
Protection Act ("COPPA") and related rules.
To complete the registration process, you will be asked to print, fill
out and fax or mail to us a registration form. That form will request
certain information concerning you and your child.
Information requested on the registration
form concerning you -- the parent -- includes both required and
optional information. Required information includes your first and last
name and email address. Optional information includes your mailing
address, home telephone number, and credit card data. Submission of the
form also gives (1) consent to your child's receipt of an email
newsletter; (2) permits your child to (a) read and post messages on our
message boards at the Site; (b) participate in live, moderated chats on
the Site; (c) enter our contests and sweepstakes and respond to special
offers, giveaways and promotions; (d) contribute an article, video or
other feature for the Site; and (e) participate in surveys or polls
conducted on the Site.
Information requested on the registration
form concerning your child also includes required and optional items.
Required information includes your child's first name, email address,
date of birth and gender. The child's last name is optional. After your
child is registered as a Member, we also may ask him or her to resubmit
his or her name and email address for the purpose of entering contests
and sweepstakes, subscribing to email newsletters or obtaining services
and information from our partners, or other purposes described in this
Notice. We may ask you to resubmit some items of personal information,
or submit new items of personal information concerning your child for
these purposes.
In our effort to provide your child with
services customized to his or her interests, we use cookies to keep and
sometimes track information. A cookie is a small piece of data that is
sent to an individual's browser from a web server and stored on the
individual's computer's hard drive. We may use cookies to access your
child's account information (stored on our computers), to estimate our
audience size for our advertisers, to identify which areas of the Site
your child has visited, and for other purposes in order to deliver
better and more personalized services. We do not otherwise use passive
technologies to track individual visitors' onsite activities without
their info.
We also want you to understand the
purposes for which information is collected from you and your child
under the age of 13. We collect first names and parents' email
addresses from persons under 13 years of age for the purpose of
obtaining registration information from the parent. We also collect
email addresses from all registered users so that it can identify and
communicate with users that may be in violation of our Terms of Use.
Finally, we use email addresses to subscribe Members to email
newsletters, allow Members to enroll in contests or sweepstakes and
provide information or services that Members ask to receive from our
partners or other purposes as set forth in this Notice. As required by
law, we do not collect more information than is reasonably necessary to
enroll a Member under the age of 13 in a contest or sweepstakes and do
not retain that information after the contest or drawing is concluded.
We also collect additional personal
information such as gender, first and last names, mailing addresses and
telephone numbers. We use this information to help tailor our content
more precisely to the needs of our users. We extract from this personal
information certain aggregate data, not identified as that of any
particular person or persons, from which we can inform potential
advertisers of the numbers and kinds of people that use the Site. By
providing this information to potential advertisers, all of whom we
evaluate in an attempt to ensure that they are responsible and
appropriate for kids before we accept their advertising messages, we
are able to attract sponsored prizes for contests and sweepstakes and
provide advertising that will be of interest to our Members. We do not,
however, send email advertising, newsletters or other information to a
Member unless the Member (or the Member's parents, in the case of a
Member under the age of 13) has elected to receive those
advertisements, newsletters or other information.
Finally, we collect credit card
information from parents, as part of the registration process, for the
sole purpose of verifying that the person filling out the registration
form is an adult. We also collect certain personal information in order
to set up accounts through which kids can purchase TECHDECK.COM merchandise. When an account is established for a child under 13, that information is requested from the child's parents.
We also protect your child's information from disclosure to
unauthorized persons we do not voluntarily disclose personal Member
information except as needed to provide or improve our service. For
example, personal information of our Members may be disclosed: (1) to a
partner of our company that establishes and administers the Member's
retail purchasing accounts; (2) to an agent or contractor for the
purpose of assisting with a contest or sweepstakes or arranging for the
mailing of prizes; and (3) to a third-party that provides information
or service to our Members at the request of those Members. we will
strive to ensure that each partner, agent or contractor to which Member
information is disclosed will use the information only for the intended
purpose, keep it confidential and not retain the information after it
is no longer needed in connection with the account, contest,
sweepstakes, or request for information or service for which the
information was collected.
Also, we may sometimes be required to
disclose personal information in response to a subpoena, warrant or
other legal process requiring it to make information available to law
enforcement, administrative agencies or parties to judicial
proceedings.
As noted earlier, we also may provide
aggregate, statistical data to responsible advertisers and other third
parties. That aggregate information does not include data from which
the identities of any Member can be determined.
As a parent, you have the legal right to
review and secure correction of personal information that we have
obtained from your child under the age of 13. You also have the right
to withdraw or limit your previous consent to our collection and use of
the personal information of your child under the age of 13. In order to
exercise these rights, parents should contact the operator of the Site

not release any personal information of children under the age of 13 to
persons claiming to be those children's parents without verification
that the child's parent is requesting the information.
If we make any material change to this
Notice or the informational practices with regard to children that were
in effect when your consent to the collection of your child's personal
information was obtained, we will - as required by law - send you a new
notice and request your consent.
We take seriously our obligation to
safeguard the confidentiality, security and integrity of personal
information collected from our Members, and have established and will
maintain procedures that are designed for that purpose. Members and
parents should be aware, however, that no system is completely secure
from hackers, network failure and error, and we cannot guarantee the
confidentiality, security and integrity of information maintained on
our service.
Finally, it is important to us that
Members and their parents understand our policy and practices
concerning the collection, disclosure and use of our Members' personal
information. We encourage you to carefully read our Privacy Policy and
